These terms are the agreement between you and Fluxternal Inc. ("Fluxternal", "we", "us") for the Nia mobile app and this website. By creating an account or using the app, you accept them. If you do not accept them, do not use Nia.
1. Who can use Nia
You must be at least 13 years old and able to enter into a contract where you live. One account per person. You are responsible for what happens under your account, so keep your sign-in details to yourself.
2. What Nia does — and what it is not
Nia is a mobile app for a nightly manifestation ritual: you write a short scene of something you want as if it has already happened, and listen to it narrated — by a preset voice or, if you choose, a copy of your own — as you fall asleep.
A ritual, not a treatment or a promise. Nia is for relaxation and reflection. It is not a medical device, it does not diagnose, treat or prevent any sleep, mental-health or other condition, and it is not a substitute for professional care. Manifestation is a personal practice: we make no promise that anything you visualise, write or listen to will happen, and every decision you make is your own.
Scene drafts, affirmations, song lyrics, songs, daily texts and narration are produced with AI models from what you give them. They can be imperfect; you can edit, re-generate or replace much of it, and you decide what to keep. The daily texts are written by AI in the style of people you describe; they are not messages from those people.
Listen only when it is safe to become drowsy — never while driving or operating machinery.
If anything it generates is offensive or plainly wrong, email hello@fluxternal.com so we can look at it.
3. Your content
What you write and record stays yours. It is stored with your account so the app works across your devices and so we can turn it into audio, songs and texts, as described in our Privacy Policy.
You promise that:
- you have the right to provide what you provide, under the law where you live;
- you only record your own voice, and you agree to it being copied to read your own scenes;
- you will not include content that is illegal, or other people's sensitive personal information;
- you will not try to copy anyone else's voice or impersonate anyone;
- you will not use Nia to harass, deceive, manipulate, stalk or coerce anyone, or to pursue anyone who has asked to be left alone.
You grant us the limited licence needed to store, transmit and process your content — including sending it to the providers named in the Privacy Policy — in order to run the service for you. We do not use it to train AI models and we claim no other rights to it.
4. Acceptable use
You agree not to:
- reverse engineer, decompile, scrape or resell the app or its output;
- use it to generate content that is threatening, sexually explicit involving minors, hateful, or otherwise against the law;
- work around usage limits, the paywall, or any technical restriction;
- disrupt the service or the systems behind it;
- share an account with other people or run it for the benefit of a third party.
We may suspend or terminate an account that breaks these rules, without a refund.
5. Subscriptions, trials and payment
- Nia Plus costs US $12.99 per week, starting with a 3-day free trial, or US $149.99 per year. Free trials are for new subscribers, with eligibility decided by the store. Prices in other currencies are set by the store and may differ.
- A free trial converts into a paid subscription automatically unless you cancel at least 24 hours before it ends. The subscription then renews automatically at the end of each period unless you cancel at least 24 hours before that.
- Billing is handled by the App Store or Google Play, depending on where you subscribed. Manage or cancel the subscription in that store's account settings (see Help) — not with us. Deleting the app or your account does not cancel a subscription.
- Refunds are handled by the store under its own policy. We cannot issue refunds for store purchases ourselves.
- We may change the price. If we do, you will be told in advance and the new price applies from your next renewal.
Some features are limited on the free plan. What is included in each is shown in the app and may change as the product develops.
6. Availability and changes
We may add, change or remove features, and we may suspend the service for maintenance or for reasons outside our control. We do not promise uninterrupted availability. We will try to give notice before removing something you rely on.
7. Our intellectual property
The app, the website, the Nia name and mark, and everything we built are ours. These terms give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you control. Nothing more transfers to you.
8. Ending the agreement
You can stop at any time by deleting your account (any tab → your initial (top right) → You → Delete my account) — cancel the subscription in your store account separately. We may suspend or close an account that breaks these terms, or where we are legally required to. Sections that by their nature should survive — content ownership, disclaimers, liability, governing law — survive termination.
9. Disclaimers
To the fullest extent the law allows, Nia is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the output is accurate, complete or suitable, or that using it will produce any particular outcome.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities, or damage to relationships or reputation, arising out of your use of Nia. Our total liability for any claim is limited to the greater of US $50 or the amount you paid us in the 12 months before the claim arose.
Nothing here excludes liability that cannot legally be excluded, and some jurisdictions do not allow these limits — in which case they apply only as far as the law permits, and your statutory consumer rights are unaffected.
11. Indemnity
You agree to indemnify Fluxternal Inc. against claims, losses and costs arising from content you provided, from your use of Nia, or from your breach of these terms.
12. Governing law
These terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws rules, and the courts located there have exclusive jurisdiction. If you are a consumer in the EU, the UK, or another jurisdiction with mandatory consumer-protection rules, this does not remove the protection or the forum those rules give you.
13. Changes to these terms
We may update these terms. If a change is material, we will tell you in the app before it takes effect. Continuing to use Nia after that means you accept the new terms.
14. Contact
App Store is a service mark of Apple Inc. Google Play is a trademark of Google LLC. Nia is not affiliated with or endorsed by either, or by any author or teacher whose ideas it mentions.
